Specification, Claims, Drawings and Photographs

  For Invention or Utility Model Application
    1. It is required for a foreign applicant to file both an original specification and a Chinese specification (i.e., a translation of the original specification). An "original" specification does not have to be a specification in the applicant's own language. For example, a German applicant may use as original specification either a German text or an English text.
    2. Multiple applications filed in a foreign country may be combined into one application so far as the unity of invention is maintained.
    3. An application for a patent of invention or utility model may have more than one independent claim. An independent claim may be further limited by one or more dependent claims, in which case each dependent claim shall refer to such other claims in the alternative way only. A dependent claim may have further dependent claims, but multiple dependent claims cannot rely either directly or indirectly on each other.
    4. The various types of claims drawn up according to the practice in the United States, Great Britain, France, Germany or Japan, are usually acceptable. However, for patent applications other than those relating to chemicals, medicines or processes, "Jepson type claims" are preferred by most examiners and applicants are often asked to re-write the claims by using this type of claims. Omnibus claims are not acceptable.
    5. For an invention relating to a chemical process, the claims must generally include the conditions of the chemical reaction, such as the range of the temperature, the catalysts, etc., and the scope claimed must be limited to the range which is reasonably supported by the examples given in the specification.
    6. The title of invention/creation must conform to the contents of claims. For clarifying the claimed subject matter, local Examiners always request that the title to be consistent to the subject matter claimed in the claims.
    7. A list of "description of reference numerals" for identifying each reference numeral and the element’s name associated therewith is one of the formality requirements for specification writing, and it could be prepared by the local agents.
    8. Informal drawings (A4 size) can be filed for obtaining an effective filing date, and formal drawings can be supplemented later.
    9. One figure and one chemical formula which can best represent the technical features of the invention shall be designated, which will be printed together with the Abstract in the Laid-Open Patent Gazette.
       
  For Design Application
    1. One design application can cover only one embodiment of a design. In case there are two or more embodiments, it is necessary to file separate application for each of the embodiments.
    2. Drawings of a design shall be presented either in one perspective view and six views (i.e. the front, rear, left side, right side, top and bottom views) of the design made on the same scale, or in two or more perspective views.
    3. The design specification shall contain a brief description which delineates the usage and features of the design.
    4. Drawings shall be drawn in accordance with engineering drawing method and shall be clearly illustrated by ink drawings, photographs or computer printouts; if color is claimed, the color scheme showing the colors applied to the article shall be submitted with the statement of the industrial color guide codes of all colors, or with color cards.
    5. Drawings shall be annotated with the name of figures. The perspective view or a view which can best represent the design shall be designated as the representative figure.
